Terms of Sale

These terms of sale are concluded between:

– on the one hand the company Nuta GmbH, holder of the domain name www.nutadesign.com and on the other hand any natural or legal person making a purchase on the site www.nutadesign.com, hereinafter referred to as “Customer”.

These conditions express the entirety of the obligations of the parties. In this sense, the Customer is deemed to accept without reservation all the provisions of these terms and conditions. No general or specific condition contained in the documents sent or delivered by the Customer will be able to be integrated into the present, since these documents would be incompatible with these general conditions.

Purpose

The present terms of sale aim at defining the contractual relations between Nuta GmbH and the Customer and the conditions applicable to any purchase of products made on the www.nutadesign.com website.

Duration

These conditions apply throughout the duration of online products offered by the company Nuta GmbH owner of the domain name nutadesign.com.

Article 1 – Acceptance of these general conditions of sale

By confirming your order, you acknowledge having read these terms and conditions of sale and accept them in their entirety.Acceptance of the general conditions of sale:The Customer acknowledges having read the terms and conditions of sale and expressly accepts them as soon as he has confirmed his order on the Site. Regarding orders that are not placed online on the site (e-mail, phone, …) the Customer acknowledges having read and expressly accepts the terms and conditions of sale as soon as he receives and does not dispute his e-order confirmation email. By accepting the terms of sale, the Customer accepts without reservation all the stipulations provided for in these conditions, to the exclusion of all others. The terms of sale are those in force on the Site at the date of validation of the order by the Customer. The terms of sale are valid for the duration necessary for the supply of the goods and services subscribed, until the extinction of their guarantees.

Article 3 – Characteristics of sold articles

The website www.nutadesign.com offers a range of jewelery and fashion items, decorative objects and artist prints, the characteristics of which are set out by : the photo, the designation, the quantity, the sizes, the price in euros.

Article 4 – Prices

All the prices indicated on www.nutadesign.com are expressed in € (euros), are freely fixed by the company Nuta GmbH and include all taxes. The total price must be paid fully at the time the order is finalized, which mean the price of the item(s) and the delivery charges. The delivery charges include shipping and packing costs.

Article 5 – Withdrawal period

The buyer has a period of 14 working days to return, at his own expense and risk, the item or items that would not be suitable for an exchange or a refund. This period runs from the day of receipt of the order. The costs of return will be the responsibility of the buyer and the conditions of the shipment must be identical. The return of the product or products is carried out in their original packaging, intact, accompanied by any accessories and in perfect condition for resale (not used, not soiled, undamaged …). Otherwise, the items will not be returned, refunded or exchanged.

Returned products travel at the expense and risk of the Customer. Any damaged product, incomplete, absent or whose original packaging has been damaged, will not be refunded or exchanged and will be returned to the Customer at its expense.

Once the buyer has exercised his right of withdrawal within the time limit, Nuta GmbH undertakes to reimburse him within 14 days from the date on which this right was exercised, the totality of the sums paid, with the exception of the expenses of return. When the period of fourteen (14) days expires on a Saturday, a Sunday or a holiday or holiday, it is extended until the next working day.

If the return of the product (s) purchased (s) is due to an error on the part of Nuta GmbH, the return costs will be fully refunded to the Customer.

Article 6 – Payment

The buyer must pay by the method of payment offered on the website www.nutadesign.com, full payment of his order at the time of its acceptance.

The payment methods accepted by the company Nuta GmbH and its online sales site www.nutadesign.com are the credit card via Stripe, or Paypal.
Nuta GmbH declines any responsibility in case of  loss of data from the company Paypal and cannot be engaged in a process of compensation which would be due by the company Paypal.
Stripe and Paypal are two totally secure online payment platforms. These methods of payment are free for you, a commission is asked to Nuta GmbH for each of your payments.

If your payment is not received within a maximum of 7 days after your order, Nuta GmbH reserves the right to cancel your order and make the item(s) available to other customers.

Article 7 – Delivery

The customer receives an order confirmation email as soon as www.nutadesign.com receives an order. The Customer must provide the references of this e-mail for any correspondence with Nuta GmbH customer service. The Customer is also informed by e-mail of the dispatch of his order, with a tracking number. If the Customer does not receive this confirmation e-mail or if he encounters difficulties in tracking his package, he must inform Nuta GmbH customer service department : nutadesign@gmx.ch

Nuta GmbH has chosen the services of DHL for the shipment of its orders. The Customer obtains his tracking number by e-mail after the shipment. If the customer does not find this email, he should check his junk mail box before contacting Nuta GmbH customer service.

If a parcel cannot be delivered to the Customer’s address because the Customer is absent, the Customer will be informed by the carrier. The carrier chooses his own way to inform the customer of his passage, which is totally independent of the will of Nuta GmbH. Nuta GmbH cannot be held responsible for the professional conscience of the deliverer, if the customer has not been informed by the transport company. In any case, Nuta GmbH cannot be held responsible if the Customer does not take the necessary steps to recover his order from the post office indicated by the delivery services of the Customer’s country. Nuta GmbH does not also be held responsible for a change of address of the Customer or recipient if he was not informed of this before dispatch.

In all cases, the Customer has a tracking number to follow his order. Nuta GmbH considers that with knowledge of this tracking number, the Customer is responsible for the removal of his parcel. After a period of 30 days after shipment, Nuta GmbH cannot be held responsible and no claim can be received by our carrier services, no refund can be accepted.

If a parcel is returned by DHL to Nuta GmbH, for impossibility of delivery, if the address given by the Customer was erroneous, if the Customer does not report a problem to Nuta GmbH or if the Customer did not withdraw his parcel despite the follow-up, Nuta GmbH cannot be held responsible. No refund can be accepted. Nuta GmbH reserves the right to return the returned package only after receipt of payment for the new shipment. Under no circumstances are these additional shipping costs refundable.

Nuta GmbH undertakes to deliver the products ordered by the Customer in a closed and resistant packaging, adapted to the contents and the requirements of transport.

 Article 8 – Damage of an article

 Nuta GmbH does not be held responsible for any damage of products because of delivery.

 Article 9 – Protection of personal data

Nuta GmbH collects customer information in an effort to enhance and personalize your shopping experience. This information allows us to communicate with our customers about our products, services and promotions.

Article 10 – Modification of these terms

Nuta GmbH reserves the right to modify at any time these terms and conditions of sale.
